Should I Open A Case Against Them?

There is a listing on eBay advertising a black iPod classic, as, and I quote “mega rare”.
I asked the seller what makes it so rare and this conversation followed:
“Hi, Just wondering, what makes this iPod so rare? Thanks :)
Seller: “its not in shops anymore and its working…. old skool”
Me: “Aren’t they?: http://www.apple.com/uk/ipodclassic/
(Note it’s available in black)
I’m just a bit worried you’re misrepresenting your item..?”
Seller: “It’s rare”
Now, I may be making a fuss over nothing, but it’s just annoying that this person feels its okay to lie about the quality of their item to make it sell better. Should I make a case against them?
